MINUTES OF THE REGULAR MEETING - Aug 9, 2004 6:00 PM

Minutes of previous meeting accepted:
Officer Lester Walker asked if the Board had received an answer from Attorney Thomas Locke regarding the children riding their bikes on the embankment on Burt Hill Rd.. Margaret McClellan answered that Attorney Locke said that the children were not on private property so there was nothing the resident could do.
Gloria Gery Updated the Selectmen as to the outcome of the Open Space Plan. Gloria indicated that the Open Space Plan would allow us to be able to apply for grants if they should come available.
The Board of Selectmen signed an Open Space Endorsement.
The Selectmen appointed John Panaia as ADA Coordinator and also appointed James Deming, Francis Deming, Monica Wilson and Gloria Gery to an Open Space Committee.
A Non-Discrimination Practices notice will be posted at all town public places.
Gloria Gery presented a telephone and computer proposal from Whalley Computer. The Board approved both proposals as long as they stayed within budget.
Robert Bitso asked for an update on Michael Lodsin of Harvey Mountain Road. Eric stated that he still has not applied for Special Permit. Attorney Locke stated that the town now needs to do an inspection of the property by the Zoning Enforcement Officer with the Fire Chief and report their findings. After that has been done the next step would be to file an injunction with either District Court or Superior Court.
Attorney Thomas Locke discussed with the Selectmen the property in Tax Title owned by Zimmerman. The property will be deeded over to the town in two separate deeds one being of 7 lots and the other 2 lots. The town is asking that Zimmerman pay the fees for the recording of the deeds.
Margaret McClellan, Treasurer requested the advice of the Selectmen and Attorney Thomas Locke in regards to a payoff amount request, from a Broker on a septic loan. Margaret stated that the loan was taken out in 1997 for $36,300 and that only 4 payments have been made. Attorney Locke reviewed the note and pointed out "3. FAILURE TO COMPLY WITH THE TERMS AND CONDITIONS OF THE LOAN. The Lender gives the Borrower notice that is payable on account of the Borrower's failure to comply with any such terms or condition. In the event the Borrower receives such a notice from the Lender, the Borrower shall forthwith pay the unpaid balance of the loan including principal and interest, with interest at the rate of 1% per month if there is any delay in my payment." Notice was sent to the borrower July 6, 2000.
The Selectmen agreed to waive the 1% and request payment of Principal and interest to date. Also, the Board will notify the borrower of this.
A mandatory department head meeting will be scheduled for the 20th or 27th of September.
